Are there up-front charges or monthly payments?No. There are no up-front charges or monthly payments. Whitehaven only gets paid at the end of your case if you recover money.
What if I lose my case?If you lose your case, Whitehaven has no recourse against you. The cash we advance to you is yours to keep.
How quickly can I get my money?After submitting your application, we contact your lawyer and request documents that aid us in determining how much money to advance. Our underwriting department reviews your case in one to two business days. After that, you can have your money overnight, wire transferred the same day, or even picked up at our office in the Empire State Building in New York City. The quicker you authorize your lawyer to release documents, the quicker you will have your money.

Why can’t my attorney advance me money?Due to conflicts of interest, most state bar associations do not permit attorneys to advance money to their clients.
Does Whitehaven have any right to participate in the case?No. Whitehaven has no right to participate in or have any input whatsoever in the processing of the case, settlement negotiations, the amount or timing of settlement, approval of settlement or any strategy related to the case. Only you and your attorney will have any say regarding these matters.
Is this transaction a loan?No. Whitehaven is making an investment in your case. You are only obligated to pay Whitehaven if your case is successful. If you lose your case, Whitehaven collects nothing and you do not have to repay the advance. This contingency differentiates this transaction from a loan, which must be paid back absolutely with no conditions.
May attorneys ethically refer their clients to Whitehaven?Yes. In almost every state, it is permissible for an attorney to refer or recommend clients to a company which provides immediate funding against a pending claim.
